Kinsman filed the suit exactly two weeks before Winston is expected to be the No. 1 overall pick in the NFL Draft. Her allegations stem from a December 2012 sexual encounter. Kinsman also has filed a Title IX lawsuit against Florida State that remains pending; the school has argued it should be dismissed.
Winston was not charged with a crime in connection with the rape allegations. A follow-up investigation by Florida State also found he did not violate the school’s code of conduct. Winston has maintained his innocence throughout the process.
