Cunningham was arrested Dec. 29 after police were called to his apartment around 4:15 p.m., according to NJ.com. Officers at the scene searched Cunningham’s Audi and found an illegally transported .380 handgun, according to Mark Spivey, spokesman for the Union County Prosecutor’s office.

Cunningham, a backup outside linebacker who missed the season with a torn Achilles, was also charged with criminal mischief for destroying clothing (method of destruction unknown) and third-degree invasion of privacy for the spreading of sexual images of an individual without consent. 

Cunningham, 29, was taken to police headquarters, processed and released without bail. He was a second-round pick by the Patriots in 2010 and will become a free agent in March.

The Jets are reportedly aware of the situation but refused to comment on the pending legal matter.
